Christian Mediation & Arbitration

Considerations for Christians

In our court system, it is the secular law that controls the outcome of cases. State government is ordained by God and applies to all people, no matter their faith. This is a good thing, and we should submit to these authorities. However, in 1 Corinthians 6, Paul is essentially asking Christians, “Why are you Christians submitting your legal disputes before a secular court that does not apply Christian principles to your cases.” If a Christian wants to honor the principle that they should have Christians help them resolve their disputes, there is a way to comply with the secular law and the Christian principle that Paul explains. This can be done through mediation or binding arbitration where the parties choose one or more Christians well grounded in Christian principles who can help them resolve their disagreements in a way that honors God in the process.

How Would it Work?

Both parties would have to agree to work under Christian principles for either mediation or arbitration. They would enter a written agreement with the ground rules for either mediation or arbitration. They would not need to have an attorney be the mediator or arbitrator, but they would need the help of a lawyer to assist in making the resolution of the mediation or arbitration binding under secular law.

Ms. McCray’s Experience

Ms. McCray has been in Christian ministry since she was 22 years old. For several years before going to law school she taught Bible study classes in women’s prisons in South Carolina, and that experience is part of what led her to become a lawyer. Over the last 31 years, she has worked with and led youth, taught Sunday school to all age groups, led singles ministries, designed and implemented a marriage program to strengthen marriages, led worship through music, assisted with revitalization of churches and ministry, and is a pastor’s wife. Throughout her practice as an attorney, her faith has guided her, and for those clients who have requested it, she has shared a Christian perspective of their legal matter. She brings a combination of ministry and legal experience that she can use to help people who want to apply Christian principles to resolving their disputes.
