Arbitration is a way to resolve disputes without going into a public courtroom setting. When should you consider arbitration instead of going to court to resolve a legal dispute?

  • When you want to preserve your privacy because you do not want your legal dispute to be made public.

  • Your legal matter is complicated or needs more attention than a public court can give it.

  • You and your attorney want some flexibility on how information is gathered and presented.

  • Your case is taking too long to resolve in the court system because of the backlog of cases.

  • You have tried mediation to resolve your legal dispute and you do not want to file a lawsuit.

Arbitration in Franklin County


The need for privacy and the desire for a quick and binding resolution makes arbitration an attractive option. A private judge (neutral third party) is hired by the parties in litigation to hear the case and make a decision on how to resolve the dispute. The decision made by the Arbitrator is binding on the parties. The parties agree to enter into Arbitration with an arbitration agreement.

Typically, both parties split the cost of the Arbitration, but this can be negotiated or placed before the Arbitrator to decide on the allocation of costs. This process is not always less expensive than Court, but the privacy and freedom in the presentation of evidence is very valuable.
